Despite Arizona's Senate vote to repeal its near-total abortion ban, the 1864 ban could stay in effect through the summer or fall.

Arizona Gov. Katie Hobbs repealed a controversial Civil War-era abortion ban that banned abortions except when necessary to save the mother’s life. However, the repeal will not take effect immediately.

The repeal will not go into effect, however, until 90 days after the state’s legislature adjourns, meaning the near-total abortion ban will briefly take effect.

With a stroke of a pen on Thursday, Gov. Katie Hobbs struck down a 160-year-old near-total abortion ban. Just a day earlier, Democrats in the state Senate succeeded in peeling away enough Republican votes to repeal an abortion ban first passed in 1864,

The Arizona state Senate voted to pass a repeal on the 1864 near-total abortion ban that the state Supreme Court approved in a ruling last month. Two Republicans voted in approving the repeal bill. It now goes to the desk of Democratic Governor Katie Hobbs to be signed into law. However a spokesperson said the signing won’t happen on Wednesday.

Arizona Gov. Katie Hobbs signed legislation Thursday that repeals an abortion ban in the state that dates to 1864, perhaps the most restrictive and oldest in the country, but the measure still could take effect briefly.

The governor's signature on a bill overturning Arizona's abortion ban does not mean the ban goes away immediately. That could be months away.
