Jury deliberations resumed Monday in the Daniel Penny subway chokehold trial, but jurors will only need to consider one lesser charge. The jury was deadlocked most of the day Friday on the other more serious charge Penny faced.

A New York City jury will begin on Monday weighing whether to convict Marine veteran Daniel Penny of criminally negligent homicide in the death of a man he placed in a chokehold on a subway train, after the jurors said last week they couldn't reach a unanimous verdict on a more serious charge.

Supreme Court Justice Maxwell Wiley approved the Manhattan District Attorney's Office request to drop the second-degree manslaughter charge because the panel of seven women and five men could not come to a unanimous decision after four days in the jury room.
